By accessing or using the Orcastrade platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.
Orcastrade provides an AI-powered advertising management platform that enables users to plan, manage, and optimize digital advertising campaigns across multiple platforms including Meta, Google, and TikTok. The Service includes media planning, budget optimization, cost transparency tools, performance reporting, and AI-driven recommendations.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Orcastrade offers multiple subscription tiers (Starter, Growth, Pro, and Enterprise). Pricing is as listed on our website at the time of subscription. We reserve the right to modify pricing with 30 days' notice. Performance fees on Pro and Enterprise plans (2-5% of ROAS improvement above baseline) apply as described during signup. All fees are non-refundable unless otherwise stated.
The Service may connect to third-party advertising platforms (Meta Ads, Google Ads, TikTok Ads) through their respective APIs. You are responsible for maintaining active accounts on these platforms and complying with their respective terms of service. Orcastrade is not responsible for any changes, downtime, or policy enforcement by third-party platforms.
Our Service provides AI-driven insights, budget recommendations, and campaign optimizations. These recommendations are suggestions only and do not constitute financial or business advice. You retain full responsibility for all decisions made based on AI recommendations, including budget allocations and campaign strategies.
All content, software, and materials on the Orcastrade platform are owned by or licensed to us. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent. Your campaign data and creative assets remain your property.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
To the maximum extent permitted by law, Orcastrade shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
Either party may terminate this agreement at any time. You may cancel your subscription through the platform settings. Upon termination, your access to the Service will be discontinued. We reserve the right to suspend or terminate accounts that violate these terms.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.
